R v C (January 2024)
The defendant was charged with assault by penetration of a woman with whom he had been friends for a long time. After a night out, it was alleged that she had gone back to his house where she had passed out before being assaulted. C was convicted following a trial. At his sentencing hearing, in which several witnesses spoke highly of the defendant, the judge deemed that a custodial sentence could be avoided and C was given a 2-year suspended sentence.
